1. Eligibility

If a product offered by us is not as described, your sole remedy is to return it in unused condition in accordance with our Return Policy.

All prices are listed in U.S. dollars unless otherwise indicated. We reserve the right to change prices at any time without notice. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

3.3 Payment

We accept credit card payments for purchases made on our Site. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full purchase amount, including applicable taxes and shipping fees.

3.4 Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in product or pricing information, or suspected fraud.

3.5 Subscriptions

By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis at the frequency you select until you cancel. You may cancel your subscription at any time by contacting us or managing your account settings. Cancellations will take effect for the next billing cycle.

3.6 Third-Party Marketplaces

Some of our products may also be available for purchase through third-party marketplaces such as Amazon. Purchases made through third-party marketplaces are subject to that marketplace’s terms and conditions. We are not responsible for issues arising from purchases made outside of our Site.

4. Shipping

4.1 Shipping Locations

We ship to addresses within the United States and internationally. Shipping availability and costs may vary by location.

4.2 Shipping Times

Estimated shipping times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our control.

4.3 Risk of Loss

All purchases are made pursuant to a shipment contract. Title and risk of loss pass to you upon delivery to the carrier.

4.4 International Shipping

For international orders, you are responsible for all customs duties, taxes, and fees imposed by your country. We are not responsible for delays caused by customs processing.

5. Returns and Refunds

5.1 Return Policy

We accept returns within 30 days of delivery. To be eligible for a return, items must be:

• Unopened and in original packaging, OR
• In new, resalable condition

We reserve the right to charge restocking fees at our discretion.

5.2 Refunds

Eligible returns will be refunded to your original payment method or issued as store credit, at our discretion. Refunds may be reduced by any applicable fees, including but not limited to restocking fees and original shipping costs.

5.3 Return Shipping

Customers are responsible for return shipping costs unless otherwise indicated by us. We recommend using a trackable shipping method, as we are not responsible for items lost in return transit.

5.4 Damaged or Defective Items

If you receive a damaged or defective item, please contact us within 7 days of delivery at [email protected]. We may request photos or other documentation to process your claim.

5.5 Non-Returnable Items

Certain items may be marked as final sale and are not eligible for return or refund.

6. Warranties

6.1 Product Warranties

Certain products may be covered by specific warranties, such as our 10-Year Warranty on orthopedic dog bed foam. Warranty terms, conditions, and limitations are outlined in our separate Warranty Policy, which is incorporated into these Terms by reference.

6.2 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN A SEPARATE WARRANTY POLICY, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR PRODUCTS WILL MEET YOUR EXPECTATIONS OR THAT ANY PRODUCT WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Intellectual Property

7.1 Ownership

All content on this Site, including but not limited to text, graphics, logos, images, photographs, videos, product descriptions, and software, is the property of Farmhouse Pet Supply or its licensors and is protected by United States and international copyright, trademark, patent, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to:

• Modify or copy Site content
• Use content for commercial purposes
• Collect or harvest any information from the Site
• Use data mining, robots, or similar data gathering tools
• Download content unless a download function is provided

7.3 Trademarks

“Farmhouse Pet Supply,” our logo, and other marks used on the Site are trademarks of North Lakes Consulting, LLC. You may not use our trademarks without prior written permission.

7.4 Patents

Certain products, including our 54-inch heavy-duty dog crate, are protected by patents or have patents pending. Unauthorized reproduction, manufacture, or sale of patented products is prohibited.

8. User-Generated Content

8.1 Submissions

Our Site may allow you to submit reviews, comments, photos, or other content (“User Content”). By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with our business.

• Infringe on any third party’s intellectual property or privacy rights
• Contain defamatory, obscene, or offensive material

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FARMHOUSE PET SUPPLY, NORTH LAKES CONSULTING, LLC, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Farmhouse Pet Supply, North Lakes Consulting, LLC, and their officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site
• Your violation of these Terms
• Your violation of any third party’s rights
• Your User Content

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

12.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or purchase of products shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules.

Arbitration shall take place in Wisconsin, or another mutually agreed location. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND FARMHOUSE PET SUPPLY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12.5 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to [email protected] within 30 days of your first use of the Site or first purchase. Your notice must include your name, address, and a clear statement that you wish to opt out.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The “Last Updated” date at the top indicates when the Terms were last revised.

14. Termination

We may terminate or suspend your access to the Site at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, Warranty Policy, and any other policies referenced herein, constitute the entire agreement between you and Farmhouse Pet Supply regarding your use of the Site and supersede any prior agreements.
